1. Acceptance of Terms
By accessing or using My PeriScope ("the Service"), creating an account, or purchasing a subscription, you ("User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you and My PeriScope ("we," "us," or "our"). Your continued use of the Service constitutes your ongoing acceptance of any changes to these Terms.
2. Description of Service
My PeriScope is a personal health tracking application designed to help women log and monitor hormonal health and wellness data across every stage of life (excluding pregnancy) — including cycle phases, perimenopause, menopause, and post-menopause. The Service lets you track symptoms, moods, cycle phases, medications, weight, journal entries, and related wellness data. The Service is intended for personal informational use only.
My PeriScope is NOT a medical device, does NOT provide medical advice, diagnosis, or treatment, and is NOT a substitute for professional medical care. Always consult a qualified healthcare provider for medical concerns.
3. Subscriptions & Billing
My PeriScope offers a free tier and a Premium subscription plan, billed on a monthly ($10/month) or annual ($110/year) basis. All prices are in US Dollars.
- Free Trial: Premium subscriptions begin with a 7-day free trial. You will not be charged until the trial period ends.
- Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless canceled before the renewal date.
- Cancellation: You may cancel your subscription at any time. Upon cancellation, you retain Premium access through the end of your current billing period. No partial refunds are issued for unused time.
- Refunds: All purchases are final and non-refundable except as required by applicable law. If you believe you were charged in error, contact us at info@myperiscope.me within 14 days.
- Price Changes: We reserve the right to modify subscription prices at any time. Existing subscribers will receive at least 30 days' notice of any price changes.
Payments are processed securely by Stripe. My PeriScope does not store your payment card information.
4. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must be at least 18 years of age to create an account. You agree to provide accurate, current, and complete information and to keep your account information updated.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a risk to other users or the Service.
5. Health Data & Privacy
You retain ownership of all personal health data you enter into My PeriScope. By using the Service, you grant us a limited license to store and process your data solely for the purpose of providing and improving the Service.
We take the privacy of your health data seriously. Please review our Privacy Policy for full details on how we collect, use, and protect your data.
You may request deletion of all your data at any time from the Subscription & Account settings page.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable law
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the integrity or performance of the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Share your account credentials with others or allow multiple individuals to use a single account
- Scrape, harvest, or collect data from the Service through automated means
7. Disclaimer of Warranties & Limitation of Liability
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any information provided through the Service.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MY PERISCOPE AND ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100.00).
8. Binding Arbitration & Waiver of Right to Sue
PLEASE READ THIS SECTION CAREFULLY. BY USING THE SERVICE, YOU AGREE TO RESOLVE DISPUTES THROUGH BINDING ARBITRATION AND WAIVE YOUR RIGHT TO FILE A LAWSUIT OR PARTICIPATE IN A CLASS ACTION AGAINST MY PERISCOPE.
Agreement to Arbitrate: Any dispute, controversy, or claim arising out of or relating to these Terms, the Service, your subscription, or your use of My PeriScope — including any tort claims, statutory claims, or claims regarding the validity or enforceability of these Terms — shall be resolved exclusively through final and binding individual arbitration, and not in any court or before any judge or jury.
Waiver of Litigation: By creating an account and/or purchasing a subscription, you expressly waive and relinquish your right to initiate or participate in any lawsuit, court proceeding, or bench trial of any kind against My PeriScope, its owners, employees, agents, or affiliates, to the fullest extent permitted by applicable law.
Class Action Waiver: You waive any right to bring or participate in any class action lawsuit, class-wide arbitration, or any other proceeding where you act in a representative capacity. All claims must be brought on an individual basis only.
Arbitration Process: Arbitration shall be conducted under the rules of the American Arbitration Association (AAA) in effect at the time of the dispute. The arbitration shall take place in a mutually agreed location or virtually. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Exceptions: Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration. This arbitration clause does not prevent you from filing a complaint with relevant consumer protection agencies.
Opt-Out: You may opt out of this arbitration agreement by sending written notice to info@myperiscope.me within 30 days of first creating your account. If you opt out, the governing law and jurisdiction clauses of Section 9 still apply.
9. Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. To the extent any dispute is not subject to arbitration, you consent to exclusive jurisdiction and venue in the state or federal courts located in Texas.
10. Intellectual Property
The Service, including its design, code, content, trademarks, and all other materials, is owned by My PeriScope and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only. No rights are granted to reproduce, distribute, or create derivative works.
11. Modifications to the Service & Terms
We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We also reserve the right to update these Terms at any time. Material changes will be communicated to registered users via email or in-app notification. Your continued use of the Service following the posting of changes constitutes acceptance of those changes.
12. Termination
We may suspend or terminate your access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination — including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability — shall survive.
